Welcome to BrandGoTech (www.brandgotech.com), a Kenyan digital marketplace for creative design templates. By registering as a vendor and selling digital products on BrandGoTech, you agree to comply with the following terms and conditions. Please read them carefully.
1. Vendor Eligibility
To become a vendor on BrandGoTech, you must:

Be at least 18 years of age.

Have the legal right to sell digital products.

Provide accurate and complete information during registration.

Own or have rights to the content you upload and sell.
2. Product Guidelines
All digital products uploaded for sale must:

Be original or properly licensed to the vendor.

Not infringe upon any copyright, trademark, or intellectual property rights.
-
Be in working condition and free of malware, viruses, or harmful code.
-
Be accurately described with proper titles, tags, images, and previews.
Prohibited content includes but is not limited to:

Pornographic, hateful, or offensive material.
-
Pirated, stolen, or counterfeit content.
-
Products that violate local or international laws.
3. Ownership & Licensing

Vendors retain ownership of their digital products.

By uploading content, vendors grant BrandGoTech a non-exclusive, royalty-free license to use, display, promote, and distribute their digital products through the platform.

BrandGoTech may use product listings in marketing, social media, and promotional activities to drive traffic and sales.
4. Commissions & Payouts

BrandGoTech charges a commission on each sale. The current commission rate is 10%, subject to change with prior notice.

Payouts are made via M-Pesa, bank transfer, or PayPal (subject to availability), with a minimum payout threshold of KSh 2000.

Payouts are processed on a monthly basis, after a clearance period of 14.

Vendors are responsible for any transactional fees or taxes associated with their earnings.
5. Vendor Responsibilities
Vendors must:

Provide ongoing support to customers regarding product usage or issues.
-
Respond to queries and complaints in a timely and professional manner.
-
Keep their product listings and profile information up to date.
-
Comply with all applicable laws, including intellectual property and tax regulations.
6. Refunds & Disputes

All digital sales are considered final unless the product is defective, corrupted, or not as described.

BrandGoTech reserves the right to issue refunds or credits to customers in justified cases.

In cases of disputes, BrandGoTech will review the matter and make a final, binding decision.
7. Termination & Suspension
BrandGoTech reserves the right to suspend or terminate a vendor account without notice for:

Violation of these terms.

Repeated customer complaints.
-
Sale of prohibited or infringing content.
-
Fraudulent or unethical behavior.
Vendors may terminate their account at any time by contacting support. However, BrandGoTech may retain copies of listings and sales data for record-keeping.
8. Limitation of Liability
BrandGoTech shall not be liable for:

Loss of income or sales due to downtime or platform issues.
-
Unauthorized access or misuse of vendor content.
-
Any indirect, incidental, or consequential damages arising from vendor participation.
9. Amendments
BrandGoTech reserves the right to modify these terms at any time. Vendors will be notified of significant changes via email or platform notifications. Continued use of the platform after updates constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes arising will be resolved under Kenyan jurisdiction.
